Dear Senator Bowen,
I have reviewed the Conditions that the Attorney General set forth to Tenet Health System DFH, Inc., a Delaware Corporation, dated December 7, 2001. I have found that Tenet DFH has not and is not complying with the conditions imposed with respect to the closure of DF Marina Hospital, Marina del Rey. I am enclosing a copy of the Conditions for your reference - 8 pages.
In particular please see the following paragraphs:
1. Paragraph 9, page 3. Contrary to paragraph IX, Tenet DFH has not established the comprehensive planning process, and has not established a local governing board to ensure continuity during the post closing operations of the Daniel Freeman Marina Hospital pursuant to Paragraph 10.3 of the Asset Purchase Agreement, nor has Tenet DFH initiated any assessment in the planning process to determine the operating and capital needs of the hospital during any period of transition to ensure continuity pursuant to Section 10.5 of the Agreement. In particular Tenet has announced their closure in letters dated May 29 and June 5, 2002 to the Medical Staff without taking any of the above steps.
2. XV Page 4. Contrary to paragraph XV, Tenet DFH has not established either an urgent care or ambulatory facility nor provided a free transportation program to near by clinics or hospitals for area residents, nor established an outreach program.
Tenet proposes to utilize Centinela Hospital, but has not shown any assessment or planning process to utilize that facility in replacement of the Marina facility.
This is obvious by virtue of the fact that the Centinela facility is located more than 2 miles from the Marina site and may not be available as an urgent care or ambulatory facility as a result of it’s proximity to the Los Angeles International Airport during homeland security terrorists threats. LAX is the number one target of terrorism for the City of Los Angeles.
There has been no attempt by Tenet to create any comprehensive assessment or planning process to address these issues. To ensure the required continuity of healthcare to the public there should be no closing of the Daniel Freeman Marina Hospital until these issues have been resolved.
We respectfully ask for your assistance in communicating to the Attorney General’s office, Bill Lockyer, that Tenet has not fulfilled their obligations in the conditions set forth for the sale of the DF Marina and Memorial Hopsitals from non-profit to profit status by the AG’s office and to request they take all necessary action to monitor compliance pursuant to Paragraph XXI of the Conditions. Under the circumstances, we request that no closing of the hospital take place until the Attorney General’s office has made a determination that Tenet is in compliance.
